"Constitution is Clear... " Suvendu Adhikari Hits Back As Mamata Banerjee Refuses Resignation
West Bengal is currently gripped by a high-stakes political deadlock following the declaration of the 2026 Assembly Election results. While the Bharatiya Janata Party (BJP) has secured a landslide victory, outgoing Chief Minister Mamata Banerjee has stunned the state by refusing to resign.
As the BJP prepares to form its first-ever government in the state, the refusal of the Trinamool Congress (TMC) leader to vacate the office has sparked a heated constitutional debate.

The political climate reached a boiling point on Tuesday when BJP MLA-elect Suvendu Adhikari, who famously defeated Mamata Banerjee in the Bhabanipur constituency, addressed the ongoing controversy.
When reporters asked for his take on the Chief Minister’s refusal to step down, Adhikari chose to keep his response brief and firm. “Everything is mentioned in the Constitution. I need not say much,” he stated while exiting the BJP’s Kolkata office, effectively invoking the law of the land to counter the TMC’s defiance.

Mamata Banerjee Defies Mandate
In a press conference held a day after the election results, Mamata Banerjee made her position clear: she does not intend to resign. Despite the BJP winning 207 seats compared to the TMC’s 80, the outgoing Chief Minister insisted that the question of her resignation does not arise.
Claiming that the TMC had achieved a “moral victory,” she refused to head to the Raj Bhavan to tender her resignation, setting the stage for a potential confrontation with the incoming administration.
Allegations of Electoral Malpractice
The TMC leadership has mounted a multi-pronged attack on the integrity of the election process. Banerjee did not mince words, accusing the Election Commission of India (ECI) of being the “villain” of this election. She raised several contentious points, including:
- Questions regarding EVM battery charge levels (claiming 80-90% charge post-polling).
- Allegations that the BJP and ECI were involved in “betting” against the TMC.
- Claims that 90 lakh names were deleted from the voter list during the Special Intensive Revision (SIR), with only 32 lakh restored after court intervention.

A Record-Breaking BJP Win
The electoral outcome represents a seismic shift in West Bengal’s political history. The BJP secured a spectacular 207 seats, dismantling the TMC’s 15-year hold on the state. For the BJP, this is not just a win; it is a two-thirds majority mandate that gives them a clear path to governance.
The loss for the TMC, which saw its seat count plummet to 80, is being described as one of the most significant electoral upsets in the state’s recent history.
Claims of Physical Assault
Beyond the claims of digital tampering and institutional bias, Mamata Banerjee has leveled serious personal allegations. She accused the BJP of playing “dirty, nasty and mischievous games,” claiming that she was “manhandled, assaulted and kicked in the belly” during the counting process. Furthermore, she alleged that CCTV cameras were switched off during these incidents, suggesting a systematic attempt to obscure the truth during the vote count.
The Impending Oath-Taking Ceremony
As the war of words escalates, the BJP is moving forward with its transition plans. With the election results declared on Monday, the party is already deep into preparations for the swearing-in ceremony of its first government in West Bengal.
The constitutional path for the transition of power is clear, but the outgoing Chief Minister’s refusal to accept the results leaves the state in a precarious position until the formal transfer of power is completed.
