Prosecutors in Washington state announced on Wednesday. their decision not to pursue criminal charges against a Seattle police officer. involved in the tragic 

incident that resulted in the death of Indian graduate student. The incident occurred on January 23, 2023.when Officer Kevin Dave struck Kandula while responding to a drug overdose call .

In their memo to the Seattle Police Department. the King County prosecutor’s office cited several factors contributing to their decision. They noted that Officer Dave had activated his emergency lights. and that witnesses reported hearing his siren though the police office. traveling at a speed exceeding 119 km/hur. 

Additionally, Kandula appeared to have attempted to cross the intersection upon noticing the approaching vehicle. It was also suggested that she may have been wearing wireless earbuds. potentially impairing her ability to hear the approaching sirens. 

Consequently, the prosecutors determined that there was insufficient evidence. to prove beyond a reasonable doubt that Officer Dave consciously disregarded safety. thus precluding a charge of vehicular homicide.

family say they felt 'betrayed'

The family of Kandula, along with their legal representative. expressed profound sorrow and indignation in response. to the prosecutor’s ruling, stating that they felt 

deeply let down by the legal system. They asserted that Dave’s conduct demonstrated blatant recklessness and negligence. emphasizing the need for accountability in Kandula’s death.

While criminal charges were ruled out, the possibility of lesser charges, such as negligent driving, remains. the case has not been referred to the city prosecutor’s. office for potential misdemeanor prosecution.
